Denied W/O Prejudice

In a curbless area still on septic tanks, a 42-unit product met opposition from the surrounding single-family homeowners.

RSJ Developments LLC, represented by Erick Cortez, proposes building 42 multifamily units on a rural 3.5-acre site. And by rural, we mean see-more-horses-than-cars rural.

The commissioners recognized the need for housing, but felt the developer's proposal was too intense for the area. Commissioner Lorie Blair, who represents the product’s district, identified the area’s need for infrastructure.

We bought these properties to enjoy our rural way of life. Raise our animals and live off the land. They (multifamily projects) bring too much noise, pollution, traffic, and congestion.

The motion to deny without prejudice passed unanimously, allowing the developer to submit a revised proposal. The concerns centered around compatibility with the surrounding single-family homes rather than opposition to any development at all. As Commissioner Hampton stated:

I think there may be a way working with the community to find a more tailored solution that would allow for an incremental increase in density that working with the community might be appropriate.

Overall, the developer faced challenges in gaining support from both the Commission and the community due to the density proposed.

Uptown | 3.98 Acres | 600-630 Units | Approved

Microunits - apartments sized at 400 square feet or less - are on their way to the Cedar Springs and Fairmount area. Both the neighborhood and city gave an enthusiastic thumbs up.

Lincoln Property Company proposed a mixed-use project with over 600 residential units, including microunits, as well as significant green space and underground parking at the corner of Cedar Springs Road and Fairmount Street.

Representative Suzan Kedron highlighted several positive features including 100% underground parking, over half the site reserved for open space, and residential units in an area now mostly used for parking. She also noted they incorporated feedback from the community during the planning process.

The Uptown Neighborhood Association (TUNA) voiced their ‘full, unqualified and enthusiastic support’ in an email read during the hearing. They appreciated the developer's ‘superior treatment of the ground plane including space programming, traffic management, and treatment of the street edge.’

The City Plan Commission was also supportive. Commissioner Kingston praised the project's inclusion of microunits, habitat gardens, green building, and transit-oriented development.

Overall, the developer received praise for creating a dynamic project with input from the community, including space for housing, parks, local businesses, and environmentally-friendly practices, ‘meeting the tests’ for density.
